Orphan Works Bill


Vorrei spiegare qualche cosa in più riguardo la petizione di cui parlavo due post fà, perchè è una cosa seria con cui prima o poi, noi disegnatori, i fotografi o gli scrittori bloggheristi ci ritroveremo a combattere.

Sono stata informata da Paolo Rui dell'Associazione Illustratori di Milano riguardo una proposta di legge al momento in discussione in America. L'intenzione è quella di cambiare le leggi sul diritto d'autore in maniera tale da dare a chiunque la possibilità di usare (anche a scopo di lucro) le immagini "orfane" della rete, che siano queste disegni o fotografie.
Per immagini "orfane", si intende tutto ciò che non è stato pubblicato da una grossa Casa Editrice (date un occhio a QUESTA pagina per una spiegazione più esaustiva), si intendono i lavori indipendenti come quelli che abitualmente io pubblico nel mio blog.

E' una proposta davvero dell'altro mondo, una cosa illegale e infame ma che negli USA hanno già provato ad avanzare due anni fa.

Contro questa porcata si stanno mobilitando illustratori e disegnatori di tutto il mondo, la notizia in AI l'hanno avuta tramite l'Illustrators' Partnership e dei considerevoli ragguagli li potrete trovare a QUESTO sito creato appositamente per informare le persone di che cosa significa non potersi avvalere della legge sul copyright. C'è una petizione in ballo, ma dopo le esperienze che ho avuto con la petizioni, sono sicura che servano a ben poco (anche se l'ho firmata ugualmente e vi invito a farlo) e "sperare" che qualcosa si smuova con una manciatina di e-mail serve ancora a meno.

La proposta di legge, al momento è tutta made in USA ma sono sicura che non tarderà a manifestarsi anche da noi visto quello che è accaduto e che continua ad accadere nei riguardi della rete. Mi riferisco alla proposta di legge Levi-Prodi o alla più recente denuncia di Mediaset nei confronti di YouTube . Questo per dire che cosa? Che dobbiamo iniziare a pensare ad un futuro in cui non avremo più la possibilità di divulgare liberamente e facilmente (senza paletti) con un mezzo immediato come il blog le nostre immagini, le vignette, le storie che altrimenti non vedrebbero la luce in altre riviste... tutto quello insomma, che facciamo noi fumettisti con i nostri blog ogni giorno.

La mia idea è quella di riuscire a creare un'isola/centro sociale all'interno della rete in cui i disegnatori abbiano la possibilità di continuare a postare le loro idee e la loro creatività ma senza perdere i diritti di copyright e quindi temere di vedere usati i propri lavori come decorazioni su infradito di plastica o quaderni scolastici senza il proprio consenso.
E' un'idea alla quale sto lavorando e accetterò più che volentieri consigli e adesioni.

THE ORPHAN WORKS BILL

The Illustrators Partnership need your help opposing legislation that will put the livelihood of every illustrator and photographer at risk, and if passed, would pretty much mean an end to any right you have to your own creations.

Despite its seemingly laudable ends, S. 2913 and HR. 5889 - the "Orphan Works Bill" needs to be opposed and defeated. And we need to do this immediately! Here's why:

1. It changes the 1976 U.S. Copyright Act (enacted in 1978), and
makes it virtually impossible for artists to protect their work. It
basically allows anyone to use a design without the copyright
holder's permission.

2. It requires artists to attempt to protect their work by
registering it with a digital data base system (presumably for a fee,
in addition to the copyright filing fee)-when no such system exists!

3. It eliminates statutory damages wherever an infringer can
successfully claim an orphan works defense, thus eliminating the only tool the law provides to prevent deliberate infringement.

4. It allows for an infringer to create-and copyright-a derivative
work from the original design.


"If we do not stop BOTH Orphan Works Bills NOW-
It does not matter that you created it.
It does not matter that you have a copyright mark on it.
It does not matter that it is registered in the Library of Congress.
It does not matter that you signed it.
It does not matter that you put a big fat watermark across it.
It does not matter that you put digital signatures on it.
It does not matter if you get a lawyer- you will get a pittance
determined by the offending company and no reimbursement for legal fees.
It does not matter even if you do as they demand and pay to register it in the new registries that they will form - there is no real punishment for using your work for profit.
It does not matter that you do not want your image used on a product or to promote an agenda.
They can even sell your prints and make money!"

Come to Daddy


Anche con lo scanner A3 non sono riuscita a beccare tutta l'illustrazione!!
L'illustrazione qui sopra è ispirata ad un pezzo (+ il video, si devono assorbire insieme per la loro bellezza) di Aphex Twin dal nome appunto: "Come to daddy".
Entrambi, mi sono piaciuti un botto e la mia illustrazione è uscita di conseguenza.
